Terms and Conditions
Please note that these terms and conditions should be read in conjunction with terms and conditions stated by Agents acting on behalf of First Class Lets. Where Agents' terms and conditions apply, these shall have precedence over terms and conditions set out by First Class Lets. Where properties have been rented solely through First Class Lets, only their terms and conditions apply.
1.
Definition of Terms
First Class Lets is the web site name of Banks and Co. The registered address of Banks and Co is Thornton Mill, Dunbar, East Lothian EH42 1QT. Parties applying to rent properties are referred to as ‘the clients' until the commencement of their let when they are referred to as ‘the Tenants'. Contracts to let property are between the owners of the properties, Banks and Co and the Tenants.
2.
Deposits
When a booking is made directly with First Class Lets more than four weeks before the commencement of the tenancy, a deposit of one-third of the total rental must be paid to confirm the booking. If a booking is made four weeks or less before the tenancy is to commence, the full rent must be paid at the time of booking.

Balance of Rental
Once a booking has been accepted, the balance of rental is payable under terms set out in paragraph 2. If the balance is not received in this time, we reserve the right to cancel the booking.
4.
Bookings
Payments to firstclasslets must be made by credit/debit card via PayPal. Firstclasslets will issue a PayPal request for payment to allow clients to make payments in accordance with the timescale set out in this document.
5.
Authority to Sign.
The person completing the booking form certifies that; he/she is authorised to agree the booking conditions on behalf of all persons included on the booking form; he/she is over 18 years of age and is a member of the party intending to occupy the property; he/she agrees to take responsibility for the party occupying the property.
6.
Tenancy Agreement
Clients are expected to take due care of the property and report any breakages. The client warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) act 1988 apply. The owners accept no responsibility for loss, injury or damage to any member of the client’s party or their property, howsoever caused, arising in any manner out of the let of the premises. The tenancy will commence at 4pm on the first day and cease at 10.30 AM on the final day, unless agreed in advance with us.
7.
Cancellation
Please inform us immediately of cancellations. Not less than 4 weeks from date of entry, we will fully reimburse you. Less than 4 weeks, no refunds. You are advised to take out your own holiday insurance.
8.
Complaints
All complaints must be referred to us during the tenancy to allow remedial action to be taken. In no circumstances can compensation be made for complaints raised only after the tenancy has ended.
9.
Non-Availability if for any reason beyond our control the property is unavailable on the day when tenancy is due to begin, clients will receive a full refund of all rents and charges already paid to us. We will make every effort to find a suitable alternative property but the clients shall have no further claim against the owners.
10.
Liability the owners accept no liability for loss or damage to the tenants’ possessions on the owners land or property.
11.
Web descriptions every effort is made to make web site descriptions as accurate as possible, except where information relates to factors beyond the control of the owners.
12.
A Booking is a legal contract governed by Scots law. The clients and the tenants submit to the exclusive jurisdiction of the Scottish courts. The contract is deemed to have been made at Thornton Mill Dunbar East Lothian.
